Preamble
The CineShop-Museum.com (CS-M) site is the property of the Sole Proprietorship "CineShop-Museum" in its entirety, as well as all rights relating thereto. Any total or partial reproduction shall automatically be submitted to its owner for approval. However, hypertext type links towards the site are authorised without any special requests.
1. Acceptance of conditions
The customer acknowledges having read and understood, at the time of making the order, the special sales conditions displayed on this screen and expressly agrees to accept them without reserve. The present general conditions of sale shall govern the contractual relations between CineShop-Museum (CS-M) and its customer, with the two parties accepting them without reserve. These general conditions of sale shall prevail over any other conditions included in any other document, unless there is a previous express and written derogation.
2. Products
The photographs illustrating the products do not form part of the contract. If errors should occur in this respect, CineShop-Museum cannot be held liable in any case whatsoever.
The vast majority (80%) of products offered by CS-M to its customers are available in our warehouse, therefore sent out within 24/72 hours upon receipt of payment (CB, Visa, Cheque, Transfer…).
However, if a different period is indicated on the Identity Record of an article (Dis: Dispatch within 5 to 10 days), we would ask that you take this into account.
3. Order
The automatic recording systems are considered proof of the nature, content and date of the order. CineShop-Museum shall confirm acceptance of the order with the customer at the email address the latter will have communicated. The sale will not be made until the order has been confirmed. CS-M reserves itself the right to cancel any order from a customer with whom there might exist a dispute relating to the payment of a previous order. The information stated by the buyer when taking the order shall bind the buyer: in the case of an error in the wording of the contact details of the recipient, the seller can not be held responsible for being put in an impossible situation in respect of delivering the product.
4. Delivery
After confirmation of the order, CineShop-Museum agrees to deliver all the references ordered by the buyer to its transporter
, and this within a maximum period of 48 working hours for DVDs, CDs and Accessories in stock, and of 48 hours to 8 weeks for the Statues. This transporter shall be bound by contract with CS-M to deliver the order to the buyer address supplied by CineShop-Museum. In the case of a cash-on-delivery transport system, the customer shall agree to pay the transporter or its representative the total of the sum indicated upon delivery of the order.
Furthermore, for deliveries outside of metropolitan France, the customer agrees to pay all taxes due for product imports, customs duties, value added tax, and any other taxes due according to the laws of the country where the order is received. All orders made with CS-M shall be for the purposes of the personal use of the customer, the customers or the recipients of the products shall refrain from reselling part or all of the products, unless of course it relates to a business or a company. CineShop-Museum absolves itself from all legal liability if the taxes are not paid by the customer.

for Metropolitan France. The delivery shall be made by directly giving the product to the recipient identified, or in the case of absence, to another person authorised by the customer. Any delays do not entitle the buyer to claim damages and interest.
Deliveries in countries of the EEC shall be made by using “Colissimo Suivi Europe” packaging or Postal Parcels: Priority Service according to the choice made by CS-M. For deliveries outside the EEC, the deliveries shall be made by Postal Parcels: International Priority Service or International Colissimo according to the choice made by CineShop-Museum. In the case of a technical product, the customer shall ensure that he or she checks that the equipment delivered works, and that he or she reads the instructions for use supplied to him or her.
In the case of noticeable defects, the buyer shall benefit from the return right according to the conditions included in this document.
The following are considered cases of force majeure absolving the seller of its obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being supplied. The goods travel always at the recipient’s risk and danger. Always check your package upon arrival. You shall have 48 hours to state any reservations towards the transporter in the case of anything missing or damaged.
For reasons of availability, an order may be delivered on several occasions to the customer. The customer shall pay for only one delivery.

5. Retraction
You shall have 7 days (starting from receipt of the items) to make a statement. In the case of exchange or refund, send back the new article(s) in its/their original packaging, intact, together with any accessories, instructions for use and documentation, to the following address:

In the case where the right of retraction is exercised, CineShop-Museum shall be required to refund the amounts paid by the customer, without charges, with the exception of restocking charges. The refund shall be due within a maximum period of two weeks.
6. Price
The cost shall be expressed in euros.
The cost indicated on the product record shall not include transport.
The cost indicated in the order confirmation shall be the definitive cost, shall be inclusive of all taxes, and shall include the VAT for France and countries of the EEC. This cost includes the cost of the products, the charges for product handling, packaging and holding, and the charges for transport and putting into service.
7. Payment
The cost invoiced to the customer shall be the price indicated on the confirmation order sent to CS-M.
The cost of the products shall be payable in cash on the day of the actual delivery.

8. Disputes
The present contract is subject to French law. CS-M can not be held liable for damages of any nature, whether material or whether immaterial or bodily, that might result from incorrect operations or incorrect use of the products sold. This also applies to any modifications to products as a result of manufacturers. The liability of CineShop-Museum shall be, in all cases, limited to the amount of the order and can not be called into question for simple errors or omissions that might have arisen despite all precautions taken in presenting the products. In the event of problems with applying the present contract, the buyer has the opportunity, before any legal action, to seek an amicable solution notably with the help: of a professional association in the sector, a consumer association or any other adviser of his or her choice. It should be remembered that seeking an amicable solution does not break the “short period” of the legal guarantee, or the period of the contractual guarantee. It should be remembered that as a general rule and subject to the view of the Courts, respect for the provisions of the present contract relating to the contractual guarantee presupposes that the buyer honours his or her financial commitments towards the seller.
Claims or disputes shall always receive close attention. Anyone making the effort to explain his or her situations will always be regarded as acting in good faith. In the event of a dispute, the customer shall firstly address the business in order to find an amicable solution.
Failing this, the Nantes Commercial Court shall have sole jurisdiction, irrespective of the place of delivery and the method of payment accepted.
9. Guarantee
CineShop-Museum guarantees that all the products chosen are manufactured or produced by official publishers. In all cases, CS-M can not be held liable for non-respect of the regulatory and legal provisions in force in the country of reception. The liability of CineShop-Museum is automatically limited to the value of the product called into question, value at its date of sale, and related to this there is no possibility of recourse towards the product brand or the company producing the product.
In any event, the customer shall benefit from the legal guarantee for ejectment and hidden defects (Art. 1625 and following of the Civil Code). Provided the buyer proves the hidden defect, the seller is legally obliged to repair all consequences of it (Art. 1641 and following of the Civil Code); if the buyer goes to court, he or she must do so within a “short period” starting from the discovery of the hidden defect (Art. 1648 of the Civil Code). 10. Legal Information
Inquiries for collecting personal information for the purposes of distance selling is obligatory, this information being essential for processing and transporting orders, and preparing invoices and guarantee contracts. Any lack of information shall result in non-validation of the order. In compliance with the "Computing and Liberties" law, the processing of personal information relating to customers was the object of a declaration with the French Data Protection Authority (CNIL). The customer shall have (Article 34 of the law of 6 January 1978) a right of access, modification, rectification and deletion of data concerning him or her, which he or she can exercise with CineShop-Museum. Furthermore, CS-M agrees to never communicate to a third party, for free or in exchange for payment, the details of its customers.
